GENERAL CONTRACTING CONDITIONS
OBJECT OF THE CONTRACT
2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of purchase-sale born between the provider and the user at the moment in which he accepts these conditions of purchase during the online contracting process by checking the corresponding box. These CGC will apply from the day the order is placed.

The contractual relationship of purchase involves the delivery, in exchange for a specific price and publicly exposed through the website, of a specific product.

2.2 Territory of application: The virtual store of www.trifanatics.es is active throughout Spain.

2.3 Ability to contract: To be able to place an order, you must be of legal age and have the capacity to contract.

3.1 Pricing: Exceptionally, the prices of the products shown on our website can be specified incorrectly and show a lower price than the corresponding price. PURCHASE PROCEDURE

SHIPPING
Shipments will be made through the company SEUR, MRW or similar, depending on the destination. The shipping costs will be applied in the following way:

The delivery time is usually between 2 working days, depending on the destination population and the chosen payment method. This term is understood as long as the availability of the goods has been confirmed and the full payment of the order has been verified.

The Provider will not assume any responsibility when the delivery of the product or service does not occur, because the data provided by the user, false, inaccurate or incomplete.

PRICES AND TERMS OF THE VALIDITY OF TENDERS
All prices displayed in the store www.trifanatics.es include the VAT in force at the time of purchase.
All the prices that appear on the website are valid except for typographical errors or end of stocks and in any case they are expressed in the Euro currency (€). Said expenses, unless expressly indicated to the contrary, do not include the costs of shipping, handling, wrapping, shipping insurance or, with the exception of others, additional services and attachments to the product or service purchased. PAYMENT METHODS
Below we detail the available systems:

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, where he must specify all the digits of the card number in the corresponding form. Financing offered and subject to the approval of Cofidis SA Branch in Spain, for amounts between 150 and 6000 € and terms of 3 to 12 months without interest. Example for financing amount: € 600. Financing offered and subject to the approval of Cofidis SA Branch in Spain, for amounts between 150 and 6000 € and terms of 13 to 24 months without interest. Example for financing amount: €1200. Number of installments: 15 First installment: € 116, remaining 14: € 80. Total amount owed: €1236. Opening fee in the first installment € 36 (minimum of € 10, 3%). TIN 0% TAE 4.66%. DELIVERY OF ORDERS

8.3 Confirmation of the shipment: At the time of delivery of the order to our carrier we will send confirmation of the shipment to the email address that you have provided when placing the order. 8.4 Damage to delivery: Products are delivered in secure packaging. A proof of delivery without any damage report is equivalent to a product with the packaging in perfect condition. Likewise, if damage is detected in the product once the package is opened and the packaging is in perfect condition, the client has 24 hours from reception to contact our customer service line 932112593 or email info@trifanatics.es. After 24 hours of delivery, no claims will be accepted for damage to the product.
WITHDRAW
9.1 Right of withdrawal: The User has 14 calendar days, counted from the date of the product, for the return of the same (article 71 Law 3/2014, of March 27). If you are not satisfied with the product or any of the products of your order, you can exercise your right of withdrawal, filling in the form attached to these conditions, with your order number (to obtain the refund of the amount of the product / s within of the maximum term of the fourteen (14) calendar days following the reception of the order) together with your contact information. Unless the return is made for defects in the product, the expenses related to the shipment will be assumed by the USER. The product must be returned in its original packaging and in perfect condition.

After this period, you can only request the return or exchange of the products for technical reasons subject to the guarantee of said product (s).

You must return the product with all the elements with which it was delivered, without damage or wear marks of any kind, and that does not denote an improper use of the good or different from the proper nature of the same to the address that we have provided.

It is advisable to return it in its original packaging, in case it is not possible, the product will suffer a depreciation in value. The customer will be responsible for the packaging and protection of the products he / she sends as well as the expenses derived from the shipment.

As long as the products are returned within a period of 14 calendar days, with no damage or wear marks whatsoever and complying with the requirements established in this section, with the return number that we will have provided, we will refund the total amount of the purchase.

9.2 Return of defective product: the user must inform Erclan Team, S.L.U of the lack of conformity with the product within two months of being aware of it. Our Customer Service will contact you via email or phone call indicating how to proceed to send the defective product and providing you with a return number.

The product (s) of the order must be returned to the address that we will provide with all the elements with which it was delivered in perfect condition, without damage or marks that denote an inappropriate use of the good or different to the nature of the same.

Once the defective product is received complying with these requirements and it is verified that the product (s) have a manufacturing defect, we will contact you to arrange the repair, replacement, reduction or termination of the contract. In any of the above cases, the related expenses will be borne by Erclan Team, S.L.U.

9.3 Return of non-defective product: When the product has no defect and its return has been motivated by ignorance or misuse, Erclan Team, S.L.U will contact you to indicate the steps to follow for the recovery of the product.

The shipping costs derived from the return of a product that does not present any defect or defect to the user will be borne by the customer and Erclan Team, S.L.U will not proceed to such shipment until having received the advance payment of transport costs. 9.7 Bicycle returns

If for any reason, you were not satisfied with the purchase of your bike, you can return it as long as it is in perfect condition, new and unused. Please, inform us within 14 days after receipt and we will arrange to arrange the return with you.

It is important to keep in mind the following:

Make sure you are satisfied with the bicycle, since once used, your return will not be accepted. We recommend keeping the original packaging in case you have to return the bicycle. If you wish to return your bicycle within 14 days, you will have to pay for the shipping costs to return the bicycle, as well as ensure that the bicycle is securely packaged for transport, as originally shipped.

Your bike is covered by the Erclan Team warranty and the respective manufacturer's warranty. For more details, contact us. If your bike develops a fault during the warranty period, contact us before returning the bike or any of its components as sometimes certain problems can be solved without incurring shipping costs. For health and safety reasons, make sure that any item you return to us is clean.
REIMBURSEMENT
10.1 Reimbursement of shipping costs: if you request reimbursement of return shipping costs, you must send the products by standard mail (regular letter). The responsibility for the shipment lies exclusively with the transport company or the medium contracted for that shipment. The additional expenses derived from the contracting of fast delivery services will be borne by the customer.

10.2 Reimbursement for reimbursement: in the case of return, reimbursement of the amounts paid will be made through the means of payment used in the purchase. Erclan Team, S.L.U will not refund the amount or return any merchandise until the receipt and the state of the packaging and the accessories of the product object of the return or change in our warehouse have been verified.

10.3 Term of reimbursement: the reimbursement will be made within a period of 15 working days from receipt and verification of the conditions of receipt of the shipment. The maximum period to make the established payment is one month. To continue with the refund, you must provide us with the following information:

10.4 Erclan Team, S.L.U declines the reimbursement of the amounts if:

- the products are used or deteriorated, or their use has exceeded their nature.
- the products lack some element.
APPLICABLE WARRANTIES AND AFTER-SALES SERVICES
11.1 Guarantee: All products offered through the website are completely original, unless otherwise indicated in its description.

All products have a guarantee period of 2 years, according to the criteria and conditions described in Law 3/2014, of March 27, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, except in exceptional cases where it maybe of different duration.

In case the Law of Guarantees of Sale of consumer goods (23/2003, of July 10) establishes that the product must be sent to the manufacturer to manage said guarantee, the team of Erclan Team, SLU will indicate how to proceed to through email or phone call. In these cases, Erclan Team, S.L.U is not responsible for how the manufacturer processes the warranty of said product.

1. Unless proven otherwise, it will be understood that the products are in accordance with the contract provided they meet all the requirements that are expressed below, except that due to the circumstances of the case, some of them are not applicable:

a) They conform to the description made by Erclan Team, S.L.U.
b) Are suitable for the uses to which products of the same type are ordinarily destined.
c) They are suitable for any special use required by the client when he has informed Erclan Team, S.L.U at the time of conclusion of the contract, provided that he has admitted that the product is suitable for this use.
d) Present the usual quality and performance of a product of the same type that the customer can reasonably expect, taking into account the nature thereof and, where appropriate, the descriptions of the specific characteristics of the products made by Erclan Team, S.L.U.
e) Erclan Team, S.L.U describes the details, technical characteristics and photographs of the products provided by the manufacturer thereof, so that it is not bound by these public statements.

2. The lack of conformity resulting from incorrect installation of the product will be equated with the lack of conformity of the same when the installation is included in the contract of sale and has been made by Erclan Team, SLU or under its responsibility, or by the USER when the faulty installation is due to an error in the installation instructions.

3. The responsibility for non-compliance that the User knows or has not been able to ignore at the time of the conclusion of the contract or that originate from materials provided by the User, will not proceed.

11.2 Defective products: In case of defective product, Erclan Team, S.L.U must proceed with the repair, replacement, price reduction or termination of the contract (as applicable), which will be free for the user. Erclan Team, S.L.U is responsible for the lack of conformity that is manifested within two years of delivery, provided that it informs Erclan Team, S.L.U of the lack of conformity within two months after it became aware of it.

11.3 Assumptions of cancellation of guarantee: The guarantee does not apply in the following cases:

Deterioration created by adaptations, adjustments or modifications made on a product without written agreement with the manufacturer,
Expenses related to maintenance, repair or exchange for parts due to normal wear and tear,
Breakdowns and deterioration of accessories,
Deterioration created by improper use of the product, inappropriate use, disrespect for the instructions for use with regard to its use and maintenance or improper installation,
Damages generated by non-accredited persons or the user,
Damage caused by accidents, lightning, floods, fires or any other cause that is not the responsibility of the manufacturer,
Damage caused by a system failure in which the product may be incorporated,
If the model or serial number of the product shows any modification,
Use of the product outside the family and private setting, for example in intensive professional use,
or
Products already repaired by Repair Services other than Erclan Team, S.L.U.

11.4 Replacement of an irreparable product: In the event that the product is considered irreparable or the cost of the repair is disproportionate to its value, it will be replaced by another exactly equal. If this is not possible, we will offer you a product with identical or superior characteristics.

The replacement of your product will terminate your sales contract and warranty extensions if any, because when you buy your new product it will benefit from a new contract as it is a new purchase.
WARRANTY CONDITIONS (Exclusive wetsuits)
XTERRA neoprene suits are guaranteed against manufacturing defects and materials for two years from the date of purchase. Proof of purchase is required, only applicable to the first owner, and is not transferable. It is not applicable to rental, used or demo costumes.

Manufacturing defects and materials covered by the two-year limited warranty include scratches, seam failures.

XTERRA will decide if the reason for the failure is a normal wear, a factory defect or a bad use of the neoprene. Based on that decision, the neoprene will be repaired or replaced. Neoprene will never be paid for a problem inside or outside the warranty.

DAMAGES COVERED BY WARRANTY
  • Seam disbonding / sewing caused by manufacturing defects.
  • Faults in the seams caused by manufacturing defects. (Note that some seam failures are due to excessive wear or normal wear and tear and they are not manufacturing defects)
DAMAGES NOT COVERED BY THE WARRANTY
  • Breaks, scratches and punctures.
  • Deformations due to sun exposure or heat.
  • Break in the leg of the suit (tears caused by putting on or taking off the suit with force and damage with the heel area, finger or anything else click, tear or break the suit)
  • Damage caused by chlorine (the degradation of sticking in the suit is the damage most common caused by chlorine)
  • Rack detachment
  • Faults due to excessive use or normal wear
TIPS AND CARE FOR YOUR NEOPRENE

To avoid possible problems, it is recommended after each use, washing with cold water. When saving for a long period of time, make sure that the suit is completely dry. Never leave to dry in the sun. Avoid hanging the neoprene on hangers for prolonged periods of time.

RETURNS & EXCHANGES

Our wetsuits pass a very rigorous control upon arrival at our warehouse. In this way we avoid unnecessary expenses and inconvenience to our customers.

After receiving your new neoprene, you will have 48 hours to contact us if there are any mistakes with the size. In case it is not the size you need, we will send a messenger to pick up the neoprene and we will send you the size you need.

If when the neoprene arrives at Trifanatics had any damage, did not have the labels or the packaging was damaged, we can not accept the change in size. They will only be accepted in cases where the neoprene is in perfect condition, with the labels and the original packaging in perfect condition and has not been used.

To ensure that the shopping experience at Trifanatics is fully satisfactory, we will not accept returns of neoprene suits for hygienic reasons.
RESOLUTION OF ONLINE LITIGATION (ONLINE DISPUTE RESOLUTION)

NULLITY AND INEFFICIENCY OF THE CLAUSES
If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, subsisting the General Conditions in everything else, having said disposition, or the part of it that was affected, by not putting.
APPLICABLE LAW AND JURISDICTION
These conditions will be governed or interpreted in accordance with Spanish legislation in matters that are not expressly established. The provider and the user, agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions, to the Courts and Tribunals of the domicile of the provider (if it is a legal entity) or the user (if it is a natural person).

In the event that the user has his domicile outside of Spain, the provider and the user, expressly waive any other forum, submitting to the Courts and Tribunals of the city of Barcelona (Spain).
